Regarding the use of electronic communications devices, Section 5/12-610.2 of the Illinois Compiled Statues provides that a person may not operate a motor vehicle on a road way while using an electronic communication device. (Sub-section b)

However, the statute also provides in sub-section (b)(8) that the law does not apply to:

“a driver using two-way mobile radio transmitters or receivers for licensees of the Federal Communications Commission in the amateur radio service”

Sec. 12-610.2. Electronic communication devices.
(b) A person may not operate a motor vehicle on a roadway while using an electronic communication device.
(d) This Section does not apply to:
     
(8) a driver using two-way mobile radio transmitters or receivers for licensees of the Federal Communications Commission in the amateur radio service;
